Terms of Service — Bull and Bear Gym

These Terms of Service ("Terms") govern access to and use of the Bull and Bear Gym online store (the "Site"), operated by Bull and Bear Gym, located at 1372 N Main St, Fuquay-Varina, North Carolina 27526 ("we," "us," "our"). By accessing the Site or placing an order, you ("customer," "you") agree to be bound by these Terms in full. If you do not agree, do not use the Site.

1. Eligibility

You must be at least 18 years of age, or the age of majority in your jurisdiction, to place an order on the Site. By placing an order, you represent that you meet this requirement.

2. Products and Descriptions

All products are apparel items made in-house in limited quantities. We make reasonable efforts to display product colors, sizing, and designs accurately, but we do not guarantee that images, colors, or descriptions are fully accurate, and minor variations between the product photo and the item received may occur due to the nature of in-house production. We reserve the right to limit quantities, discontinue products, or correct pricing or description errors at any time without prior notice.

3. Pricing and Payment

All prices are listed in U.S. dollars and are subject to change without notice. Payment is due in full at the time of order. We reserve the right to refuse or cancel any order, including for suspected fraud, pricing errors, or unavailability of inventory, and our sole liability in such cases is limited to refunding the payment received for the canceled order.

4. Orders

All orders are final once placed and cannot be modified or canceled by the customer. Order confirmation does not guarantee product availability; in the rare case an ordered item is unavailable, we will notify you and issue a refund or store credit for that item at our discretion.

5. Shipping

Shipping timelines provided at checkout are estimates only and are not guaranteed. We are not responsible for delays caused by carriers, weather, or other events outside our control. Risk of loss and title for products purchased pass to the customer upon our delivery to the carrier.

6. Returns and Refunds

All sales are final, subject to the limited exceptions described in our separate Return & Refund Policy, which is incorporated into these Terms by reference. No returns, refunds, or exchanges will be issued outside the terms of that policy.

7. Intellectual Property

All logos, designs, artwork, product images, and content on the Site, including the Bull and Bear Gym name, mascot, and apparel graphics, are the property of Bull and Bear Gym and are protected by applicable trademark and copyright law. You may not reproduce, distribute, modify, or create derivative works from any Site content without our prior written consent.

8. Prohibited Use

You agree not to use the Site for any unlawful purpose, to attempt to interfere with the Site's operation or security, to submit false or fraudulent order or payment information, or to resell products purchased from the Site without our prior written consent.

9. Disclaimer of Warranties

The Site and all products are provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement, except to the extent such warranties cannot be excluded under applicable law.

10. Limitation of Liability

To the fullest extent permitted by law, Bull and Bear Gym shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, arising from your use of the Site or purchase of any product. In all cases, our total liability to you for any claim arising from your use of the Site or any product shall not exceed the amount you paid for the product giving rise to the claim.

11. Indemnification

You agree to indemnify and hold harmless Bull and Bear Gym, its owners, employees, and affiliates from any claim, loss, or damage, including reasonable attorneys' fees, arising from your violation of these Terms or misuse of the Site.

12. Governing Law and Disputes

These Terms are governed by the laws of the State of North Carolina, without regard to conflict of law principles. Any dispute arising from these Terms or your use of the Site shall be resolved exclusively in the state or federal courts located in Wake County, North Carolina, and you consent to personal jurisdiction there.

13. Changes to These Terms

We may update these Terms at any time without prior notice. Continued use of the Site after changes are posted constitutes acceptance of the revised Terms. The version posted on the Site at the time of your order governs that order.
